Terms of Service

These Terms of Service govern the use of the Ementado platform (the "Service"), available at ementado.pt. By creating an account or using the Service, you accept these terms. In case of doubt, the Portuguese version prevails.

1. Who we are

Ementado is operated by Guilherme Gomes, Portuguese tax number 249772175, based in Águeda, Portugal, hereafter "we" or "Ementado". For any question about these terms, contact us at ementado@ementado.pt.

2. What the Service is

Ementado lets you create and publish digital menus for restaurants, bars, cafés and similar businesses, generate custom QR codes that point to that menu (or to any other link you choose), and order vinyl stickers for the tables, linked to the menu.

Creating and editing a menu, as well as previewing it, is free and needs no account. An account is only needed to save the menu, publish it with a permanent link, or see statistics.

3. Accounts and responsibility for content

You must be at least 18 years old to create an account. By creating an account you accept these terms and confirm you have read the Privacy Policy.

You are responsible for keeping your password confidential and for all activity carried out through your account. You are also solely responsible for the content you put in your menu (dish names, prices, descriptions, images, logo). Ementado does not check or edit that content, and is not responsible for its accuracy, including allergen information or prices.

4. Payments

Some extras (high-resolution QR code, unlocking a menu's QR code, the Menu made by us, services by professionals, table stickers and kits) are paid, with the price shown before purchase. Ementado Pro and Ementado Casa Cheia are subscriptions, with their own terms shown before activation. Payments, by card or, for one-off payments, by MB WAY, are processed entirely by Stripe; Ementado never receives or stores your card details.

All prices shown on Ementado are VAT exempt under article 53 of the Portuguese VAT Code (CIVA): no VAT is added to the amount shown. There are no hidden fees: the amount you see before paying is the amount charged. Shipping for table stickers, when it applies, is shown before purchase.

Right of withdrawal: digital files (high-resolution QR code) are delivered immediately after payment. By completing the purchase you expressly request that immediate delivery and acknowledge that, under Portuguese law (Decree-Law 24/2014), you lose the 14-day right of withdrawal as soon as the file is made available for download. For custom table stickers, being made to order, the right of withdrawal also does not apply once production has started.

Ementado Pro: monthly or yearly subscription, renewed automatically until cancelled, which includes up to three menus on the same account (the free plan includes one). You can cancel at any time from the subscription management page; Pro stays active until the end of the period already paid, and periods already started are not refunded. When a subscription ends, menus stay online and return to the free plan's limits: photos beyond the ten free ones stop being shown, but stay stored and come back if Pro is reactivated. Yearly Pro comes with 10 free table stickers, on the terms in section 5.

Ementado Casa Cheia: monthly (€24.99 a month) or yearly (€239.90 a year) subscription, renewed automatically until cancelled, which includes everything in Ementado Pro, with the same cancellation rules: Casa Cheia stays active until the end of the period already paid, and periods already started are not refunded. It also includes:

• Featured on the Ementado guide (Casas Ementadas): the account's menus appear first in their town and in their type of place, and are picked more often by "Surprise me". It is a paid placement, so it is always identified as advertising, with the "Em destaque" (featured) label and a note saying these are places on the Casa Cheia plan. Places on Ementado Pro come next, above places on the free plan, also identified, with the "Destaque" label and the same note. Among featured places, the order changes every day. Being featured does not change the prices, reviews or rating of any place, and when searching for a dish the order is still by price.
• 50 vinyl stickers without table numbers, shipping included, once per account. They become available when the Casa Cheia payments add up to the value of two months of the monthly plan (€49.98, counted on what was paid, after discounts): on the yearly plan, right after the first payment; on the monthly plan, from the second month paid. If you move from Pro to Casa Cheia, the difference you pay for that change counts too. They are ordered in one go, for a single menu on the account, with the proof, lead time and guarantee in section 5, and each one carries its own code. They have no cash value and cannot be moved to another account. If, before you order them, the payment that gave them is refunded and Casa Cheia no longer adds up to the two months, the right to them is cancelled. Yearly Casa Cheia also brings the 10 table stickers from yearly Pro.
• No Ementado branding at the end of the menu and on your place's page.

Changing plan: if you have Ementado Pro, you can move to Casa Cheia from the dashboard whenever you like, within the same period (monthly or yearly). The change applies at once and you only pay the difference between the two plans until the end of the current period, calculated by the day; the renewal date stays the same, now at the Casa Cheia price. If you have Casa Cheia, you can move back to Pro: you keep Casa Cheia until the end of the period already paid, with no refund, and the next renewal is at the Pro price; until then, you can undo the change at no cost. The plan cannot be changed while a payment is overdue, or while the subscription is cancelled for the end of the period. When you move back to Pro, the stickers you have already received are yours to keep.

Starter offer, the first month free: while it is active, and only for a limited number of places, an account that has never had a paid plan starts Ementado Pro or Casa Cheia with a free period of 30 days (or the number of days shown at checkout, before you enter your card). The card is requested at the start and the first charge is made at the end of the free period; seven days before, we send an email with the date and the amount. If you cancel before that day, you pay nothing. It is once per account and cannot be combined with the welcome discount of the Mesa a Mesa programme. The stickers included in the yearly plan and the 50 Casa Cheia stickers become available after the first payment, on their own terms. We may end the offer at any time; anyone who has already started it keeps it until the end of the free period.

Menu with Photos (legacy): this service is no longer available for new purchases; unlimited photos are now part of Ementado Pro. Anyone who already had it keeps the benefit until the end of the paid period.

Menu made by us: for €29.99, one-off, we build the digital menu from the photos, PDF and instructions you send through the form. The usual turnaround is two working days from payment. It is an estimate, not a guaranteed deadline: if we need more time, or need to ask you questions, we let you know by email.

When the menu is published, it moves to your account. The menu is yours, you change it whenever you like, and you can switch it off or delete it like any other menu you created. The accuracy of prices, descriptions and allergen information remains your responsibility: we build the menu from what you send us, and you should check everything after receiving it.

Refunds: until we deliver the menu, you can cancel the request and we refund the full amount. If the material you send does not allow us to build the menu, and we cannot agree with you on how to solve it, we also refund the full amount. After delivery, because it is a made-to-order service fully performed at your request, there is no longer a right of withdrawal.

In case of a payment error or a problem with the delivered file, contact us: we solve it case by case.

5. Table stickers

What they are: printed vinyl stickers, cut to shape, with a matte (by default) or gloss finish and permanent adhesive. They are only made for Ementado menus: each table sticker carries a code of its own that opens the place's menu and, if you ask for it, the table number; the QR code is always 4 cm or larger. The table pieces are the Signature (110 × 125.7 mm), the Place setting (150 × 102.6 mm), the Table (80 × 120 mm) and the Small (60 × 90 mm). The Wall and counter piece (A5, 148 × 210 mm) is sold individually, for €6.90; the Window (210 × 148 mm) and the Door sticker (round, 120 mm) only come in the kits.

Price: table pieces are priced per table: €3.90 a table for an order of 6, getting cheaper with every table you add, down to €2.50 a table from 50. For example, 6 tables cost €23.40, 20 cost €69 and 50 cost €125. The minimum order is 6 tables, counting the spare stickers without a number (0, 2 or 4). You can also order them all without table numbers, at the same price: each one keeps its own code. Above 100 tables, we quote by WhatsApp. The total, with shipping, is shown before you pay.

The proof: before paying, you see on screen a proof of every table, with the name of the place and the menu's address, and approve it in one go. Nothing is printed until the proof is approved and the order is paid. Check the table numbers and the name carefully: we print what you approve. If what you receive does not match the approved proof, we redo it at no cost.

The table codes: they become active when the order is produced. While the menu exists, each code opens it, even if you change the dishes, the prices or the menu's address. If the menu no longer exists, the code opens Casas Ementadas instead.

Lead time and delivery: stickers arrive in 5 to 12 working days from payment. This is an estimate, not a guaranteed deadline: if we need more time, we let you know by email. Postal delivery is free to any address in Portugal, mainland and islands. Stickers travel by standard post; the order with the pieces of a kit travels by registered post, with a tracking number. Until delivery to you, the risk of loss or damage in transit is ours: if a piece arrives damaged, contact us and we replace it at no cost.

Guarantee: if a sticker peels, fades or the code stops scanning with normal use, we replace it at no cost, with the same design and the same code, for 12 months indoors and 6 months outdoors (on a terrace, for example), from delivery. The guarantee does not cover damage caused by direct heat (hot plates or pans, flames, heaters) or by abrasive products (scourers, abrasive cleaning powders or creams). This guarantee adds to your rights under the law and does not replace them.

Yearly Ementado Pro: each new yearly Ementado Pro subscription (€95.99 a year), and also each yearly Casa Cheia (€239.90 a year), comes with a credit of 10 table stickers, shipping included. The credit stays in your account and is used when ordering the table stickers for one of your menus, with the same proof and lead time. It is given once per subscription: renewals do not bring a new credit. Each order paid with credit takes at least 6 stickers, or all that are left. It has no cash value, cannot be moved to another account, and any unused credit is cancelled if the payment that gave it is refunded.

Kits:

• Mesa Posta, €100: 12 months of Ementado Pro, 10 table stickers, the Door sticker and one A5 Wall and counter piece.
• Casa Ementada, €150: 12 months of Ementado Pro, the Menu made by us, 20 table stickers, the Door sticker, one A5 Wall and counter piece and the Window.
• Inauguração, €300: the same as Casa Ementada, with 30 table stickers, two A5 pieces and photos of up to 40 dishes, on the terms for services in section 7.

The tables in a kit stay as a credit in your account and are ordered like any others, with the proof. They go by post to any address in Portugal, shipping included. As with yearly Pro, each order paid with credit takes at least 6 stickers, or all that are left, and unused credit is cancelled on a refund. The tables in a kit are ordered in up to two parts: the second order takes all the tables that are left. The Ementado Pro in the kits is a yearly subscription: after 12 months it renews at €95.99 a year, and you can cancel it whenever you like. Kits are for accounts that do not have Ementado Pro or Casa Cheia yet; if you already have one of these plans, order the stickers and the Menu made by us separately. Kits cannot be combined with discount codes. The Menu made by us in the kits follows the terms in section 4.

6. Mesa a Mesa programme

Anyone with an account can recommend Ementado to another business through their link. The invited business is linked to whoever recommended it when it creates an account through that link, or when, not having been brought by anyone and never having had Ementado Pro, it signs in to its account through that link. The first link counts, for good. The recommendation counts when that business pays the second month of Ementado Pro or Ementado Casa Cheia. The rewards for each tier are those shown on the programme page on the day they are earned, and go to the account of whoever recommended. Nobody can invite themselves, and each invited account counts only once. We may change future tiers; rewards already earned are not withdrawn.

7. Services by professionals

What they are: from your dashboard, you can order work done by professionals from Ementado, at a fixed price:

• Complete Menu, €249: we build your menu with all of your place's information (opening hours, address, contacts, allergens and languages), with photos of every dish in the same style, up to 40 (drinks are not photographed), and with 12 months of Ementado Pro. After the 12 months, Pro renews at €95.99 a year, and you can cancel it whenever you like. If you already have Ementado Pro, you pay €153.01 and the Pro you have carries on as it is.
• Paper menu, €89: made from your Ementado menu, ready to print.
• Poster, €29: for the dish of the day or for an event.
• Simple logo, €249.
• 3 Reels, €179: three videos of 15 to 30 seconds, filmed at your place.
• Social media, €149 or €249 a month: 8 posts a month and stories of the dish of the day, or 12 to 16 posts a month plus handling messages and comments. It is a monthly subscription: you can cancel whenever you like, and the month already paid is carried out in full.

Like every price on Ementado, these are VAT exempt (art. 53 CIVA). They are always the prices on the site: the professional does not charge extras or give discounts of their own.

Who does them: independent professionals from the Ementadores network, chosen and certified by Ementado. Ementado sells, charges for and guarantees each service: you pay only Ementado, never the professional. We choose the professional for each job, preferably in your place's municipality.

Turnaround: photos are uploaded within 48 hours of the session and added to the menu in the hours after approval; the menu is built in 3 working days; design work is ready in 5 working days and videos in 7 days; social media starts within 7 days. When a job needs a session at your place, the date is agreed between you and the professional. These are estimates, not guaranteed deadlines.

Approval: when the work reaches you, you see it in your dashboard and either approve it or ask for it to be redone, giving a reason. You have 7 days, counted from when the delivery reaches you: if you say nothing within that time, the delivery is approved. The professional redoes it at no cost. If you ask for it to be redone a second time, the job passes to another professional or to us. Some deliveries, such as each professional's first jobs, go through our review first, which only lets them through to you or sends them back to be redone. The decision to approve or ask for it to be redone remains yours, and what we send back in the review does not count as a request of yours. For social media, each month is delivered and approved separately.

The guarantee: "If you don't like it, we redo it. If you still don't like it, we refund what you paid for the service." Once the work has been redone at your request, you can ask for the refund in your dashboard. For social media, each month is approved separately: after a month has been redone, the refund is requested in your dashboard and is for that month's amount. As for the right of withdrawal, since these are made-to-order services, what section 4 says for the Menu made by us applies.

Photos and delivered work: you may use them on your menu, on social media and in your place's materials, with no time limit. The professional keeps the copyright and may show them in their portfolio. Ementado may show them to promote the service. Photos only get minor adjustments to light, colour and cropping, never images generated or altered by artificial intelligence: the dish in the photo is the dish that is served. Once approved, the photos go to the dishes on your menu and become public, like the menu's other photos. If a dish already had a photo, the new one takes its place; the old one is kept, and you can ask us to put it back. The accuracy of dishes, prices and allergens remains your responsibility.

Who brought your place: an Ementador is linked to your place if you created your account through their link, or if you signed in to your account through one of their links when your place had not yet been brought by anyone and had never had Ementado Pro. The first link counts, for good. In your dashboard you see their name, phone number and area. For having brought you, the Ementador receives a commission from us on some of your place's payments, at no extra cost to you. They are an extra contact: our support stays the same. What they see about your place is described in the Privacy Policy.

Direct contact: the professional may not charge you anything on the side or offer you the catalogue services directly. If this happens, let us know at ementado@ementado.pt.

8. Cancellation and account deletion

You can stop using the Service at any time. You can delete your account from the dashboard, under "Delete account": your menus are unpublished, the account and its data are deleted, and an active subscription (Pro or Casa Cheia) is cancelled immediately, with no refund for the current period. You can also ask for deletion by email. Payment records that the law requires us to keep are retained for the legal period.

9. Availability and changes to the Service

We make a reasonable effort to keep the Service available, but do not guarantee uninterrupted availability. We may change, suspend or discontinue features, giving reasonable notice whenever the change negatively affects accounts already created.

10. Limitation of liability

The Service is provided "as is". To the fullest extent permitted by law, Ementado is not liable for indirect losses, lost profits, or unavailability of the public menu, including in situations outside our control (for example, unavailability of the providers Supabase or Stripe).

11. Governing law

These terms are governed by Portuguese law. For any dispute, the court of the consumer's place of residence has jurisdiction where applicable, or otherwise the legally competent forum.

12. Changes to these terms

We may update these terms from time to time. Relevant changes will be flagged on the platform with the revised update date at the top of this page.

13. Reviews from people who ate there

How reviews are verified: a place can only be reviewed by someone who opened its menu from the table code (the QR code the place has on its tables, such as the one on each Ementado table sticker), which carries a key of its own. Opening the menu this way allows one review from that phone within 4 hours. The same phone, recognised by an identifier stored in the browser, can only review the same place again after 30 days. To stop abuse we also count reviews per internet connection (at most three per place per day) and per place, without storing the reviewer's IP address, and the owner's account cannot review its own place. When many reviews reach the same place in a row (more than three in the same hour, or ten in the same day), the next ones are held until Ementado checks them. The public menu link, shared or found online, does not allow reviewing.

What is published: the stars (1 to 5), the dishes the person chose, and the comment and name if they write them. A place's rating only shows from 3 reviews. We do not pay or give anything in exchange for reviews, and places may not either.

Replies and reports: the owner can reply publicly and can report a review, but cannot delete it. A reported review stays visible until Ementado decides. We only remove reviews with insults, illegal content, advertising, other people's personal data, or that are clearly not about that place. An honest review is not removed for being negative. Comments with offensive language are refused before publication.

Reviewers are responsible for what they write. If a review by you or about your place seems abusive, write to ementado@ementado.pt.
